General Terms and Conditions (GTC)

1. Scope and Contracting Party

These General Terms and Conditions (GTC) apply to all orders placed through our online shop HOLYGRADE at www.holygrade.com. The contracting party is Blockreaction Investments GmbH, Kirchstrasse 10, 4227 Büsserach, Switzerland (VAT ID CHE-440.274.758), hereinafter referred to as "HOLYGRADE" or "we".

Any conflicting or deviating conditions of the buyer will not be recognised unless we have expressly agreed to their validity in writing.

2. Offer and Formation of Contract

The display of products in the shop does not constitute a legally binding offer, but rather an invitation to place an order. By clicking the order button, you submit a binding order. Confirmation of receipt of the order is sent immediately after submission by an automated email. This confirmation of receipt simultaneously constitutes acceptance of your order — the purchase contract is thereby concluded.

HOLYGRADE reserves the right not to accept orders for valid reasons (e.g. supply shortages, doubts about the delivery address, technical errors in price display). In such cases, any amount already paid will be refunded without delay.

3. Prices and Shipping Costs

All prices are stated in Swiss Francs (CHF) inclusive of the applicable Swiss value added tax (8.1%), where applicable. For deliveries abroad, shipment is made in accordance with Incoterm DAP (Delivered At Place); any import taxes, customs duties, and clearance fees are to be borne by the recipient.

4. Delivery and Delivery Time

Delivery is made to the delivery address provided by the customer. The estimated delivery time is generally 1–2 business days within Switzerland, 3–5 business days to Germany and Austria, and 5–8 business days to other EU countries, from receipt of payment. If an item is unavailable, you will be notified promptly.

Partial deliveries are permitted where reasonable for the customer and will not incur any additional costs.

5. Payment

Payment is generally due in advance unless otherwise agreed. Available payment methods (e.g. TWINT, credit card, PayPal, Apple Pay, Google Pay) are displayed at checkout. In the event of late payment, we reserve the right to cancel the order and charge any costs incurred.

6. Retention of Title

The delivered goods remain the property of HOLYGRADE / Blockreaction Investments GmbH until payment is made in full.

7. Right of Withdrawal / Returns

Consumers are entitled, under Swiss practice and EU law, to a right of withdrawal of 14 days from receipt of the goods. The full withdrawal notice including the model withdrawal form can be found under Right of Withdrawal. Return shipping costs are borne by the buyer. Excluded from the right of withdrawal are, in particular, goods sealed for hygiene reasons, opened booster packs and trading cards, as well as individually ordered items.

8. Warranty

The statutory warranty provisions of Swiss contract law (OR — Swiss Code of Obligations) apply. Defects must be notified in writing within a reasonable period after discovery. HOLYGRADE will choose at its own discretion between repair, replacement delivery, or refund.

Obvious transport damage must be reported immediately and no later than 48 hours after receipt. For the fastest possible processing, please attach photos and contact us via the contact form or at support@holygrade.com.

9. Liability

HOLYGRADE is liable without limitation for damages caused by intent or gross negligence. For slightly negligent breaches of duty, liability is limited to the typically foreseeable damage. For transport damage, liability rests in principle with the contracted shipping provider within the scope of its insurance.

Liability for indirect damages, loss of profits, or depreciation in value of collectible items (e.g. due to market developments) is excluded to the extent permitted by law.

10. Product Information and Trademarks

We endeavour to provide product descriptions and images that are as accurate as possible. Minor variations in colours, packaging, or edition details may occur between manufacturer batches and do not constitute a defect. Brands such as "One Piece", "Pokémon", "Bandai", and "The Pokémon Company" are the property of their respective owners; HOLYGRADE is not an authorised dealer of these brands but deals exclusively in original products from the legitimate trade cycle.

11. Privacy

Personal data is processed confidentially and only for the purpose of fulfilling the order. Details are governed by our Privacy Policy.

12. Final Provisions

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Büsserach, Switzerland, unless mandatory statutory provisions dictate otherwise. Should any individual provision of these GTC be invalid, the validity of the remaining provisions shall not be affected.
